Information privacy
As part of the buying and selling process, we collect some of your personal information such as your name, address and email address when you make a purchase from our store.
We will not pass on this information to anyone else unless we are required to do so by law, or if you violate our Terms and Conditions.
We will only send you emails about our store, new products and other updates with your consent. This is obtained when you ‘opt-in’ to receive email marketing. You can change your mind any time by emailing us at info@urbanbardesign.com.au
When you click on links from our store, you may be directed away from our website. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
Payments
If you choose a direct payment gateway to complete your purchase, your transaction data is only stored for the amount of time it takes to complete your purchase. After that is complete, your purchase transaction information is deleted.
Third party providers used by us will only collect, use and disclose your information for as long as it takes to perform the services they provide to us.
Payment gateways and other payment transaction processors have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. Products and services
We have made every effort to display as accurately as possible the colours and images of our products that appear on our online store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right to limit the sales of our products to any person or geographic region.

Returns and exchanges
Customer Information
Please consider your purchase carefully. Items sold in clearance may be end of run, samples, seconds or slightly imperfect, they are NOT subject to any warranty claim and cannot be return for credit or refund if you are not satisfied.
All goods are guaranteed for 30 Days from the date of purchase against manufacturing defects. Goods are considered faulty if there is a manufacturing or structural defect that would affect the practical use and performance of the product. Fabric imperfections, stains & marks may not be considered manufacturing faults or defects.
Colour fastness is NOT warranted or considered a manufacturing defect, and no assertions are made to colour fastness. It is the responsibility of the buyer to test for colour fastness prior to using any goods purchased.
WARRANTY
All goods are guaranteed for 30 Days from the date of purchase against manufacturing defects. Goods are considered faulty if there is a manufacturing or structural defects. Fabric imperfections, stains & marks may not be considered manufacturing faults or defects. Colour fastness is not warranted or considered a manufacturing defect, and no assertions are made to colour fastness. It is the responsibility of the buyer to test for colour fastness prior to using any goods purchased.
It is advised that all goods be washed separately before first use and in accordance with washing instructions to determine their suitability to be fit for purpose.
Any goods purchased must be fit for purpose and it is the customers responsibility to ensure that goods are fit for purpose and used in accordance with that purpose.
A warranty claim must be made within 30 days from the date of purchase, or the claim can be denied.
The use of goods subject to a warranty claim should cease immediately once the claim is lodged and until the claim is dealt with and finalised.
The further use of goods subject to a warranty claim will immediately void the claim.
Urbanbar Design cannot be held responsible for any decision made by the user to continue to use goods which are subject to a warranty claim where that use could cause an adverse outcome.
The following Terms and Conditions apply to the Return or Exchange of Goods
• If you wish to return any goods purchased you will be required to contact our office at info@urbanbardesign.com.au explaining your reason for return. Once your email is received by us you will be notified and given a Return Order Number. No returns will be processed without a Return Order Number.
• Once agreement has been reached to return goods they must be returned and received within 30 days of the date of invoice unless otherwise agreed.
• Goods purchased on Clearance cannot be returned for exchange or refund.
• Goods should be in their Original Saleable Condition complete with all packaging material.
• Goods should not be used or altered and must be free of damage.
• Copy of the Invoice should be included with the return to identify the items & date of purchase.
• Return Shipping Costs - Return shipping costs will be borne by the purchaser unless otherwise agreed.
• Change of Mind - Under the Australian Consumer Law (ACL), the customer is not entitled to a refund or replacement for a change of mind. However, if Urbanbar Design agrees to accept the goods back a restocking fee of up to 25% of the value of the goods, including the freight charge may apply.
• Customised, Personalised or Branded goods - Any goods that have been made to order, embroidered or screen printed cannot be returned once purchased.
• Clearance Items - Cannot be returned for Credit, Refund or Exchange.

The following Terms and Conditions apply to the Return or Exchange of Goods
• Faulty goods can only be returned by prior written agreement. All requests to return goods must be in writing to info@urbanbardesign.com.au with a reason for return accompanied by photos & proof of purchase.
• If faulty goods are being returned for a refund or exchange, the goods can only be returned as prescribed by Urbanbar Design Company at our expense. No postage or carrier cost will be paid prior to the return of the goods unless otherwise agreed.
Additional Terms
Urbanbar Design Pty Ltd and its directors reserve the right to charge a re-stocking fee of up to 25% of the value of the goods if deemed applicable.
Urbanbar Design Pty Ltd and its directors reserve all rights in regard to all matters contained herein and will have the final say if a dispute arises regarding any of our products or services.
Account information
When you purchase from Urbanbar Design, you agree to provide us with current, complete and accurate purchase and account information. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
Modifications
We will endeavour to keep you informed as changes occur to our website and to our products. However, we reserve the right to modify or discontinue the website or products without notice. Prices for our products are subject to change without notice.
We are not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of products or the website.
Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website, or on any related website, is inaccurate at any time without prior notice (including after you have submitted your order).
Disclaimer of warranties and limitation of liability
We do not guarantee that your use of our website will be uninterrupted, timely, secure or error-free.
You agree that from time to time we may remove the website for upgrades or maintenance, or products, for indefinite periods of time, or cancel the website without notice to you.
You agree that your use of, or inability to use, the website is at your sole risk. The website and all products delivered to you are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Urbanbar Design, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages arising from your use of our website or any products procured using the website, or for any other claim related in any way to your use of the website or any product.
Intellectual property
By using our website, you agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our products without written permission by us.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.
Termination
If we believe you fail, or we suspect that you have failed, to comply with any of these Terms and Conditions, we may terminate the agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.
Consumer guarantees
If you believe an item is faulty, you may have rights to a remedy under the Australian Consumer Law. These rights are not impacted by the change of mind policy or limited by a defined timeframe. However the Australian Consumer Law does recognise that the relevant time period may vary by product depending on the nature of the goods, the price paid and any representations made about the goods.
Where you believe an item is faulty, it may be necessary for us to send your goods to the manufacturer or their service agent for it to be assessed within a reasonable period of time. If there is a major failure with the item, you may choose a refund, exchange or repair. If the failure is minor, we will repair or replace the item within a reasonable time.
Where an item is damaged through misuse or abnormal use, Urbanbar Design cannot provide a refund, exchange or repair, whether the fault is identified by Urbanbar Design, the manufacturer or their service agent.
Urbanbar Design will require satisfactory proof of purchase before providing a remedy under the Australian Consumer Law.
